Home Chef: Terms and Conditions

If you are a Home Chef and wish to use the MyTree App, an app promoted by My Tree Digital Ventures Pvt Ltd, you may do so in accordance with the terms of this Section (along with Section A of the General Terms and Conditions given in your Profile as a Customer) as may be applicable to you.

1. Introduction

Upon registration as a Home Chef, in consideration of your compliance with these terms and conditions, MyTree will provide you with the provision to create your own online profile as described on the App.

2. Registration

In addition to the registration requirements in Section A of the main Terms & Conditions available in your Customer profile, you acknowledge and agree that registration as a Home Chef may include additional verification requirements.

3. Home Chef Profile Services

Subject to clause 1.4 of Section A (MyTree App shall not be liable for any losses, damages, costs, or expenses arising from or in connection with any modification, discontinuance, suspension, or unavailability of the App, including but not limited to preventing you from using the App or any of the Services available thereunder), the Chef profile will comprise the following:

  1. The facility to create a Chef Profile page (including a photo), which can be accessed by the Users
  2. The facility to customize your Profile by adding information about your experiences, cooking preferences, food specialty
  3. The ability to advertise Meals or other homemade food items available for Order
  4. The ability to set a purchase price (“price”) payable by the User in respect of any Meal
  5. The ability to specify whether you are able to offer Delivery of Orders or they are to be collected
  6. The ability to post reviews and ratings about other Home Chefs as a User
  7. Any other features provided by MyTree on the App to Home Chefs from time to time.
4. Home Chef Profiles

1. You warrant that you are the provider of the Meals you have posted on your Chef Profile.


2. You must ensure that your Profile contains the minimum information set out below:


i. information as to your identity;

ii. a description of the Meals available

iii. the Price of the meal being offered.

iv. all other information regarding the meal being offered that is asked by the form to upload your dish

5. Your Additional Obligations As A Home Chef

1. By choosing to be a Home Chef and to advertise and deliver your Items to Users through the App, further to the general obligations on you as a User under section A of the General Terms & Conditions, you agree that all information submitted by you in a Home Chef preparation and supply and/or delivery of the Items, and any other information provided (including the recipes and ingredients relating to the Items) to Users or other Home Chefs through the App, must:

i. be accurate, correct and up-to-date

ii. be provided with all reasonable care and skill in a manner consistent with generally accepted standards in the food industry

iii. not breach any applicable statutory or regulatory requirement, including following good hygiene practice in the preparation of any Meals and, where applicable, food safety management procedures based on the standards set by the Food Safety and Standards Authority of India (FSSAI) from time to time

iv. not be misleading, deceptive or in any way contravene any and all applicable consumer, health and safety and e-commerce laws and regulations; and

v. not be obscene, defamatory or be in the reasonable view of MyTree deemed to be offensive and/or inappropriate.


2. In using the Home Chef feature you must:

i. at all times keep all information including without limitation, communication and correspondences between you and the Users, and all information relating to the Order process secure and confidential

ii. immediately notify MyTree in the event you have any reason to believe or suspect that a Home Chef, Seller or User has breached any of its Terms.


3. You further acknowledge and agree that MyTree may, at its sole discretion, immediately remove your Profile from the App where it reasonably considers that such Profile, any information you have uploaded or Meals provided, no longer meets the standards that MyTree requires of its Home Chefs/Sellers on the App, at its absolute discretion and upon written notice to you.

6. Charges And Payments

All payments from Users made through the App shall be made via such payment processor as MyTree may choose (“Payment Processor”) to MyTree, who will remit to you:


i. the amount received from the Users in respect of the Order (“Sale Price”);

ii. less any fees charged by the Payment Processor; and

iii. less our commission at the rate notified to you (“Commission”),

iv. less the CGST & SGST on the Commission within thirty (30) days of receipt of the applicable payment by MyTree from the Payment Processor


2. Where a User requests a refund, the Home Chef shall comply with the Refund Policy as specified by MyTree from time to time.


3. You shall pay all other fees and charges (if any) notified to you during the registration process (“Fees”). The Fees shall be due and payable in accordance with the payment terms notified to you during registration. The Fees are exclusive of GST and other taxes which shall, where applicable, be paid in addition.


We may change the Commission and/or Fees at any time on the provision of notice to you in writing, by email or through your use of the App. Your continued use of the App following notice of such change shall be deemed to be your acceptance of the new Commission and/or Fees. If you do not agree with the changes to the Commission and/or Fees, you may choose to not post your dishes or products on the app.

7. Additional Exclusion Of Warranties

1. You acknowledge and agree that MyTree only provides you with the facility to post and supply homemade items and/or products to Users by providing you with the Online Platform Services. MyTree does not warrant, represent or guarantee that you will find any Users to deliver Homemade Items to or achieve any specific results whatsoever.


2. You acknowledge and agree that using the App or accessing its features requires registration as a business and a food hygiene & safety certificate from the FSSAI. Your use and reliance on any information on the App shall be at your own risk and MyTree shall not be liable whatsoever for any damages and loss which you may incur as a result of or in connection with your use and reliance of such information. You undertake to conduct your own research and ensure that you comply with the requirements applicable to you. MyTree shall not be liable to you for any failure by you to comply with any relevant laws and regulations that may apply to you in the use of the App or the features thereunder.


3. You further agree that MyTree does not vet or verify the identity of the Users posted on the App. Consequently, MyTree does not warrant or guarantee:


i. the currentness, completeness, correctness and accuracy of any Users’ Profile;

ii. that any Orders made by Users are genuine;

iii. the identity of the Users using the App.


4. You further acknowledge that MyTree has no control of and therefore has no liability whatsoever in respect of the behaviour, response and quality of the Users on the App.


5. MyTree provides the Online Profile Services solely to connect you, the Home Chefs, with Users who may be seeking to Order homemade food items or products from you. You acknowledge and agree that you are solely responsible for all communication with, and any subsequent dealings with, Users (including but not limited to the terms upon which you create and deliver Meals or Products to Users). You, the Home Chefs, hereby indemnify MyTree in full and on demand against all losses, damages, costs, claims and expenses that MyTree incurs (including but not limited to such losses and damages incurred by MyTree in respect of sickness, disease or death of any User arising out of or in connection with your acts or omissions in the use of the Platform) arising out of or in connection with any of your dealings with, or Meals or products provided to the Users.

Basic Chef Guidelines

1. FSSAI Registration

It is desirable for all chefs who post on the MyTree Home Kitchen to have an FSSAI Registration Number. An FSSAI Registration costs Rs.100 per year and can be taken for multiple years as well. The registration process can be completed online.

2. Posting dishes on the App

1. Frequency of posting: As a MyTree chef you may post as many times as you like on the app. Posting at least 2 dishes a month on the app will keep you on the app’s roster as an Active Chef. An Active Chef is eligible for special privileges, discounts, schemes etc. that MyTree offers from time to time under the Chef Privilege Program. If you post less than twice a month you will still be deemed a MyTree Chef but may not be able to avail of the privileges mentioned above that may be offered from time to time.


2. Quantity for sale: As Chef, you decide how many plates you want to offer for sale. The minimum is 1 plate and the maximum is your capacity. If you post a smaller number of plates and they get sold out, you can add more plates to your dish as well.


3. Price of your dish: You are free to price your dish as you think appropriate, keeping in mind value for money, quality of the ingredients and the market price for a similar dish. Two chefs can post the same dish at different prices at the same time on the app. MyTree does not regulate any pricing on the App.


4. How much quantity should you serve in a portion?: A ‘Quantity per plate’ guideline will be given to you. We have arrived at these quantities after extensive feedback from our current chefs. Please try to follow the same as it is easier for customers to know what to expect, it maintains uniformity for the customers, and they know what to expect.

3. Packaging

1. MyTree Stickers: All packaging must compulsorily have the MyTree sticker on it. The stickers are provided to the Chefs at no cost, and will be replenished upon request. MyTree will conduct random checks with customers to know if their food was delivered with the sticker on the packaging.


2. Hygiene in preparation: All chefs must take care to prepare their food in the most hygienic way possible using only fresh and good quality ingredients.


3. Hygiene in packaging: All food must be packed for delivery in fresh new containers. Please do not use any old boxes or containers to pack your food. Hot food must not be packed in plastic containers.


4. Charges: MyTree takes no membership fee from its chefs. A nominal Commission with 18% GST will be charged on the price of the dish.

4. Payments

a. Cash on Delivery: All Cash on Delivery orders are collected directly and retained by the Chef. MyTree does not collect any cash on behalf of customers. The Commission and GST will be charged to the Chef and settled against the outstanding amount payable to the Chef by MyTree.

 

b. Online payments (OLP): These are payments received through Netbanking, credit or debit cards , GPay, UPI or PayTm. These payments come to the MyTree account and will be settled at fixed intervals with the chefs. MyTree will deduct the charges for online as well as cash payments before transferring the balance. No credit card charges will be deducted.

 

c. MyTree Points (MYP) redemption: The app gives points to Customers to encourage them to order and increase your sales. Points are given out at different times and for different reasons. Customers collect these points and use them to order on the app. MyPoints orders are treated the same way as any other order and there’s no difference in reimbursement to the Chef.

There are 2 ways in which points can be transferred to your account.

  • (i) Transferred to your bank account with other order payments:

  • (ii) As Points in the Chef’s account (less Commission+GST)

d. Delivery charges: When a customer pays online for her order she pays the delivery charges as well. Chefs need not collect these separately from the Customer. MyTree will pass on the collected amount to you at the time of settlement. For COD orders you will collect the delivery charges at the time of delivery from the Customer.

5. Cancellation Policy and Terms & Conditions

The Cancellation policy, as well as Terms and Conditions for customers, are mentioned in detail on the App. Please take a few minutes to go through the same.

6. Cancellation Policy for Chefs

1. A Chef can delete dishes she has uploaded on the app. However, the orders that have been already received against such a dish will have to be fulfilled.


2. A Chef can cancel orders received by her only in extreme circumstances after informing the competent authority at MyTree of the same. If you have cancelled an order due to extreme circumstances, the Customer will get a full refund for the same.


3. A Chef who cancels a dish will not be penalized for the same as it is done only under extreme circumstances.

7. Special features

MyTree has several features that make it easier for you to create a strong profile for yourself and grow your business.

 

a. Referral button: You will find the Refer button in the main menu on the top left of the screen. When you click the refer button you get a message with your unique referral code. You can share this on WhatsApp, SMS etc. with other people in your chapter. When they download the app using your referral code, they get 100 points to use on the app and you also get 20 points. The more people you get on the app, the better chances of building a loyal clientele for yourself and for collecting points that you can use freely to order food for yourself.

 

b. Share button: Once you post a dish on the app you can share it with your customers, friends using the “share’ button via WhatsApp or other media. This is a very useful feature. Many times, customers miss out on ordering what they like because they were not on the app. The share button lets them know when you have posted a new dish. They can see the photo, the name of the dish and your name. By clicking on the link they go straight to the dish and they can order it directly.

 

c. Reposting dishes: You can build your set of dishes at your time and convenience and post the dishes on the app from this set whenever you are ready by merely editing the details you want to. You may have some dishes that are very popular, and you post most often on the app. You can use the repost button to do so easily with this feature.
