Seller Terms & Conditions

Welcome to MyTree! We are delighted to have you onboard and we are sure you will find it a rewarding and enriching experience. We have put together a few basic guidelines to help you make the best use of the app and make the most of all its features.

If you are a Seller and wish to use the MyTree App, you may do so in accordance with the terms of this Section (along with Section A of the General Terms and Conditions given in your Profile as a Customer) as may be applicable to you.

1. Introduction

Upon registration as a Seller, in consideration of your compliance with these terms and conditions, MyTree will provide you with the provision to create your own online profile as described on the App.

2. Registration

In addition to the registration requirements in Section A of the main Terms & Conditions available in your Customer profile, you acknowledge and agree that registration as a Seller may include additional verification requirements.

3. Seller Profile Services

Subject to clause 1.4 of Section A (MyTree App shall not be liable for any losses, damages, costs, or expenses arising from or in connection with any modification, discontinuance, suspension, or unavailability of the App, including but not limited to preventing you from using the App or any of the Services available thereunder), the Seller profile will comprise the following:

 

  1. 1. The facility to create a Seller Profile page (including a photo), which can be accessed by the Users;

  2. 2. The facility to customize your Profile

  3. 3. The ability to advertise your products available for Order

  4. 4. The ability to set a purchase price (“Price”) payable by the User in respect of any product.

  5. 5. The ability to offer discounts to customers via the app

  6. 6. Any other features provided by MyTree on the App to Sellers from time to time.

4. Seller Profiles

1. You warrant that you are the provider of the Products you have posted on your Seller Profile.

2. You must ensure that your Profile contains the minimum information set out below:

i. information as to your identity;

ii. a description of the products available

iii. the Price of the product being offered.

iv. all other information regarding the product being offered

5. Your Additional Obligations As A Seller

1. By choosing to be a SELLER and to advertise and deliver your Items to Users through the App, further to the general obligations on you as a User under Section A of the General Terms & Conditions, you agree that all information submitted by you as a Seller and any other information provided relating to the items uploaded for sale, to Users or other Sellers through the App, must:

 

i. be accurate, correct and up-to-date;

ii. be provided with all reasonable care and skill in a manner consistent with generally accepted standards in your industry;

iii. not breach any applicable statutory or regulatory requirement, including following good hygiene practice in the preparation of any Meals (if selling food) and, where applicable, food safety management procedures based on the standards set by the Food Standards Agency (FSSAI) from time to time;

iv. not be misleading, deceptive or in any way contravene any and all applicable consumer, health and safety and e-commerce laws and regulations; and

v. not be obscene, defamatory or be in the reasonable view of MyTree deemed to be offensive and/or inappropriate.

 

2. In using the Bazaar Seller feature you must:

  • i. at all times keep all information including without limitation, communication and correspondences between you and the Users, and all information relating to the Order process secure and confidential;

  • ii. immediately notify MyTree in the event you have any reason to believe or suspect that a Home Chef, Seller or User has breached any of its Terms.

You further acknowledge and agree that MyTree may, at its sole discretion, immediately remove your Profile from the App where it reasonably considers that such Profile, any information you have uploaded or product provided, no longer meets the standards that MyTree requires of its Sellers on the App, at its absolute discretion and upon written notice to you.

6. Charges And Payments

1. All payments from Users made through the App shall be made via such payment processor as MyTree may choose (“Payment Processor”) to MyTree, who will remit to you:


i. the amount received from the Users in respect of the Order (“Sale Price”);

ii. less any fees charged by the Payment Processor; and

iii. less our commission at the rate notified to you (“Commission”),

iv. less the CGST & SGST on the Commission within thirty (30) days of receipt of the applicable payment by MyTree from the Payment Processor


2. Where a User requests a refund, the Seller shall comply with the Refund Policy as specified by MyTree from time to time.


3. You shall pay all other fees and charges (if any) notified to you during the registration process (“Fees”). The Fees shall be due and payable in accordance with the payment terms notified to you during registration. The Fees are exclusive of GST and other taxes which shall, where applicable, be paid in addition.


4. We may change the Commission and/or Fees at any time on the provision of notice to you in writing, by email or through your use of the App. Your continued use of the App following notice of such change shall be deemed to be your acceptance of the new Commission and/or Fees. If you do not agree with the changes to the Commission and/or Fees, you may choose to not post your dishes or products on the app.

7. Additional Exclusion Of Warranties

1. You acknowledge and agree that MyTree only provides you with the facility to post and supply homemade items and/or products to Users by providing you with the Online Platform Services. MyTree does not warrant, represent or guarantee that you will find any Users to deliver products to or achieve any specific results whatsoever.


2. You acknowledge and agree that using the App or accessing its features requires registration as a business and a food hygiene & safety certificate from the FSSAI. Your use and reliance on any information on the App shall be at your own risk and MyTree shall not be liable whatsoever for any damages and loss which you may incur as a result of or in connection with your use and reliance of such information. You undertake to conduct your own research and ensure that you comply with the requirements applicable to you. MyTree shall not be liable to you for any failure by you to comply with any relevant laws and regulations that may apply to you in the use of the App or the features thereunder.


3. You further agree that MyTree does not vet or verify the identity of the Users posted on the App. Consequently, MyTree does not warrant or guarantee:


i. the currentness, completeness, correctness and accuracy of any User’s Profile;

ii. that any Orders made by Users are genuine;

iii. the identity of the Users using the App.


4. You further acknowledge that MyTree has no control of and therefore has no liability whatsoever in respect of the behaviour, response and quality of the Users on the App.


5. MyTree provides the Online Profile Services solely to connect you, the Sellers, with Users who may be seeking to Order food items or products from you. You acknowledge and agree that you are solely responsible for all communication with, and any subsequent dealings with, Users (including but not limited to the terms upon which you create and deliver food or Products to Users). You, the Sellers, hereby indemnify MyTree in full and on demand against all losses, damages, costs, claims and expenses that MyTree incurs (including but not limited to such losses and damages incurred by MyTree in respect of sickness, disease or death of any User arising out of or in connection with your acts or omissions in the use of the Platform) arising out of or in connection with any of your dealings with, or Meals or products provided to the Users.

Other Seller Guidelines

The MyTree Bazaar is the ideal place for companies seeking to sell their products to customers in local communities. The Bazaar allows you to sell food as well as non-food items through the application.

The MyTree Bazaar is divided into two sections:

  1. My Market: for Sellers who have 1-3 items for sale

  2. My Mall: for Sellers who have more than 3 items for sale. You can apply to be on My Mall by clicking on the

Product categories

All food and non-food items can be sold on MyTree except for the following categories:


No products past their expiry date

No opened or used products

No fake brands or replicas of famous brands

No items that require special licenses such as liquor, medicines, or tobacco

No items that are inflammable or can cause injury or harm

No items that are harmful to kids, senior citizens, or pets

Products must be mindful of cultural sensitivity


MyTree reserves the right to take down a product that we believe violates our guidelines.

FSSAI Registration for food products

If you serve Food products (cooked or uncooked) it is mandatory to have an FSSAI Registration Number.

Commission
  1. MyTree charges a percentage as a service fee from all sellers for posting their items on the app. There will be a GST charge of 18% on this margin.

  2. The final price that the customer sees on the app will be inclusive of the margin and GST so please calculate accordingly.

  3. Items are shown on the app in order of the commission they offer in descending order, with the highest on top.

Payments

Bazaar Customers can only pay online or with MyTree Points (MYP), or a combination, for their purchases. No COD will be allowed.


MyTree will deduct the total Commission + GST payable to the Seller against your total sales and transfer the balance due to your bank account. There will be no cash transfers.

Cancellation Policy

Please refer to the Cancellation Policy for Customers.

Shipping and Delivery

MyTree does not offer any shipping or delivery services. All Sellers will have to provide for delivery. You can set your Delivery charges while uploading your products.

Deals of the Day

You can offer discounts on your products. Deals of the Day will list products offering a minimum discount, such discount to be fixed from time to time by MyTree. You can change the discount or remove it whenever you want from your dashboard.

Complaints

If a Customer reports a purchase to the app, the Seller will be responsible for addressing the issue to MyTree and the Customer’s satisfaction.

Cancellation Policy for Bazaar
  1. Seller cannot cancel an order placed by a Customer.

  2. Customer can cancel any time before the order is shipped and get a full refund.

  3. After the product is shipped, the Customer can return the product and receive a refund from the Seller directly in line with the Seller’s cancellation and refund policy. No responsibility for refund accrues to MyTree in this case.

  4. Refund will be made in the same manner as the payment was made. If the payment was made online, the refund will be made accordingly. Else if the payment was through MYP, then the Customer’s account will be credited with MYP.

  5. In the case of Reported Orders where the Customer has a problem, the Seller can offer the Customer a replacement. If the Customer does not accept the replacement, MyTree will issue a refund on behalf of the Seller and charge the Seller the same.
